Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BugBasket platform, website and services (collectively, the “Service”) operated by BugBasket (“we”, “our”, “us”). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users and others who wish to access or use the Service.

• “Service” means the BugBasket platform, including the website, dashboard, widget, API and all related services.
• “User” or “you” means the individual or entity that registers for and uses the Service.
• “Account” means your registered account on the BugBasket platform, including all associated data and settings.
• “Content” means all data, feedback, screenshots, videos, text and other materials submitted through or generated by the Service.
• “Widget” means the embeddable BugBasket feedback component that can be installed on your website or application to collect user feedback.

To use the Service, you must create an account. By creating an account, you agree to the following:

• You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service.
• You must provide accurate, current and complete registration information, and keep this information up to date.
• You are responsible for maintaining the security and confidentiality of your account credentials. You must not share your password with others.
• You are responsible for all activity that occurs under your account, including actions taken by team members you invite.
• You must notify us immediately at legal@bugbasket.com of any unauthorized use of your account or any other breach of security.
• One person or legal entity may not maintain more than one free account.

BugBasket provides a feedback collection and management platform. The Service includes:

• Feedback collection widget: An embeddable component that allows your users to submit bug reports, feature requests and general feedback including screenshots, screen recordings and annotations.
• Dashboard: A centralized interface to view, manage, prioritize and respond to collected feedback, available at app.bugbasket.com.
• Integrations: Connections with third-party tools such as project management platforms, communication tools and development workflows.

We reserve the right to modify, suspend or discontinue any part of the Service at any time, with reasonable notice where practicable.

You agree not to use the Service to:

• Violate any applicable local, national or international law or regulation.
• Engage in any illegal, fraudulent, abusive or harmful activity.
• Infringe on the intellectual property rights of others.
• Transmit any malware, viruses, worms or other harmful code.
• Attempt to gain unauthorized access to our systems, networks or other users' accounts.
• Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the Service.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Collect personal data of end users without appropriate legal basis and disclosure.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

Paid plans are billed in advance on a monthly or annual basis. All prices are listed in euros (EUR) and are exclusive of applicable taxes unless stated otherwise.

• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Payment is processed securely through our third-party payment provider (Stripe). We do not store your full payment card details.
• Prices may be subject to change with at least 30 days' written notice. Price changes will take effect at the start of your next billing period.
• Failure to pay may result in suspension or downgrade of your account.

You may cancel your subscription at any time from your account settings. Upon cancellation:

• Your account will remain active until the end of your current billing period.
• We offer a 30-day money-back guarantee for new subscriptions. If you are not satisfied within the first 30 days, contact us for a full refund.
• You may export your data at any time before your account is deactivated. We provide data export functionality in your dashboard settings.
• After the billing period ends, your data will be deleted within 30 days in accordance with our Privacy Policy.
• We may terminate your account if you violate these Terms, with or without prior notice.

The Service, including its original content, features, functionality, design and underlying technology, is owned by BugBasket and protected by international copyright, trademark and other intellectual property laws.

You retain all rights to the Content you submit through the Service. By using the Service, you grant us a limited, non-exclusive license to store, process and display your Content solely for the purpose of providing the Service to you. We do not claim ownership of your data or Content.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use and protect your personal data. Please review the Privacy Policy carefully.

To the maximum extent permitted by applicable law, BugBasket shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, business opportunities or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in the Netherlands.

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days' notice before any material changes take effect, by posting the updated Terms on this page and notifying you via email or through the Service.

Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service.
